Risk and Responsibility Agreement

This agreement allocates responsibility for the selection, receipt, handling, storage, research use, transfer, and disposal of products supplied by Everwell Peptides.

Acceptance is required. Purchasing, receiving, possessing, or using an Everwell product confirms your understanding of its research-only designation and your agreement to assume responsibility for lawful laboratory handling.

Qualified Research Handling Is Your Responsibility

Research materials may present known, unknown, or incompletely characterized hazards. The purchaser controls the product after delivery and accepts the duties associated with that control.

Agreement and Acceptance

This Release is part of the agreement between the purchaser and Everwell Peptides. It applies when you access product information, place an order, accept delivery, possess a product, or permit another person or organization to handle it.

If you purchase for a laboratory, company, institution, or other organization, you represent that you are authorized to accept these obligations for that entity.

Research-Only Status

Everwell products are supplied solely for lawful laboratory, analytical, and in-vitro research. Research labeling does not authorize personal, consumer, medical, veterinary, diagnostic, therapeutic, preventative, or clinical use.

Everwell is not a pharmacy, compounding pharmacy, healthcare provider, veterinary provider, medical laboratory, or treatment organization. Product information and COAs do not constitute professional advice or a guarantee of fitness for a particular experiment.

Purchaser Representations

  • You are at least 21 years old and legally able to enter this agreement.
  • You are acquiring products exclusively for legitimate research.
  • You possess suitable training, facilities, procedures, controls, protective equipment, and disposal resources.
  • You will independently evaluate product identity, documentation, suitability, and legal requirements.
  • You will restrict access to trained and authorized personnel.
  • You will comply with applicable laws, regulations, institutional rules, and approved protocols.

Prohibited Uses and Conduct

You may not consume, ingest, inject, inhale, implant, apply, administer, prescribe, dispense, compound, or otherwise introduce a product into a human or animal body. You may not instruct, assist, encourage, or permit another person to do so.

You may not relabel, advertise, resell, transfer, or distribute a product for a prohibited purpose or make unsupported claims regarding safety, effectiveness, approval, diagnosis, treatment, or disease prevention.

Research and Laboratory Risks

Research materials may have hazardous, variable, unstable, reactive, contaminated, degraded, or incompletely understood properties. Risks may arise from exposure, storage, reconstitution, transfer, concentration, incompatibility, equipment failure, environmental release, disposal, or experimental error.

You acknowledge that published information may be incomplete or later revised and that a COA describes the tested sample or batch rather than guaranteeing a particular result in your laboratory.

Receipt, Storage, Handling, and Disposal

Inspect each shipment and label before use. Do not use a product that appears damaged, compromised, mislabeled, contaminated, or materially inconsistent with the order. Preserve evidence and contact Everwell promptly.

You are responsible for controlled storage, access restrictions, inventory records, personal protective equipment, engineering controls, validated procedures, spill response, transportation, and disposal under applicable requirements.

Knowing Assumption of Risk and Release

You knowingly accept risks associated with acquiring and controlling research materials, including risks that are known, unknown, foreseeable, or not fully characterized.

To the fullest extent permitted by law, you release Everwell and its owners, officers, employees, contractors, affiliates, suppliers, and service providers from claims arising from your selection, possession, handling, storage, research, transfer, disposal, prohibited use, failure to follow documentation, or failure to comply with law.

This release does not apply to liability that cannot legally be waived.

Limitations of Liability

To the maximum extent permitted by law, Everwell will not be liable for indirect, consequential, incidental, special, exemplary, or punitive damages, lost profits, lost data, business interruption, experimental failure, or losses caused by improper storage, misuse, unauthorized transfer, purchaser negligence, third-party activity, or events beyond reasonable control.

Any applicable aggregate liability will not exceed the amount paid to Everwell for the specific product giving rise to the claim, except where a greater remedy is required by law.

Purchaser Indemnification

You agree to defend, indemnify, and hold the Everwell parties harmless from claims, damages, liabilities, penalties, judgments, and reasonable expenses arising from your breach, unlawful or prohibited use, negligent handling, false representation, transfer, resale, disposal, or infringement of another party's rights.

Third Parties and Product Transfers

You remain responsible for any person who obtains access through you. A permitted transfer must comply with law, preserve all original labels and documentation, and be made only to a qualified recipient who accepts equivalent research-use restrictions.

Transfer to an unqualified person or for a prohibited purpose is forbidden and does not relieve you of responsibility.

Applicable Law and Non-Waivable Rights

This Release must be read with the Terms & Conditions, Shipping & Returns Policy, Privacy Policy, and checkout acknowledgments.

Nothing here eliminates a right or remedy that cannot be waived, excuses unlawful conduct, or prevents Everwell from approving a replacement, credit, refund, or other remedy under an applicable policy.
